Holland: School Wrong To Insist Teacher Wears Muslim Headscarf

We reported earlier that Samira Haddad was refused employment at Amsterdam's Islamic College because she would not wear a hijab or Muslim headscarf.

Today, the Equality Commission ruled in 32-year old Ms Haddad's favour, stating that the college wrongfully deprived her of work, states Expatica. In October a member of the school board said "If Miss Haddad was to declare she is not a Muslim then she could, in principle, come and work with us." The Equality commission noted this statement and said it showed that the school was less concerned about a person relinquishing her faith than relinquishing the hijab.

The commission said the school should not have refused the woman on the basis of this "prohibited distinction". In some cases, the commission emphasises, demands could be made in relation to an employee's clothing. But only when that was necessary to achieve the aims of the school.
Despite this ruling, the Equality Commission has no powers to compel the Islamic College to hire Tunisian-born Ms Haddad. For its part, the ICA said it was "not happy" with the judgement. They have been asked by the Equality Commission to respond to the ruling by 13 December. "We have nothing to say until then," said a spokesman.
