US: Islamist Jose Padilla Requests Supreme Court Hearing
A report from today's Washington Post by Gina Holland describes how Jose Padilla (pictured) has asked the Supreme Court to limit the time that he and other suspected terrorists may be detained by the government without charges being made against him.
Padilla is accused of plotting to detonate a radioactive device, a so-called "dirty bomb". Padilla has been in a military jail for 3 years now. Last year, his request to appeal against his detention was refused by a vote of 5 to 4 against, in a ruling that stated Padilla had made his request in the wrong court.
A federal judge in South Carolina ordered the government to either release Padilla or charge him, but a Circuit Court of Appeals in Richmond, Virginia, ruled that the president had the power to use military detention against US citizens who were "closely associated with al-Qaeda, an entity with which the United States is at war."
The Bush administration claims that the need for national security is so high, the rights of terror suspects are secondary to the constitutional rights afforded normal US citizens. The Supreme Court has disagreed, and late this year, Padilla's case will be heard, though not with Bush's chosen judge Harriet E. Miers on its panel.
As well as being of interest on a constitutional issue, the Padilla case highlights the growing emergence of radical Islam in US jails. According to a report published by the Department of Justice, entitled "A Review of the Federal Bureau of Prisons' Selection of Muslim Religious Services Providers, from April 2004, Jose Padilla, "arested for attempting to detonate a dirty bomb in the United States, converted to Islam after serving time in a Broward County, Florida, jail where authorities suspect his islamic radicalization began". So what is known about Padilla? Born in Brooklyn on October 18 1970, he was called by the nickname "pucho" or "pudgy" because of his fat cheeks when the family moved to Chicago when he was 8. There he became involved with gang culture. His parents moved to Florida in 1991 and he joined them, and became involved in gun crime.
He attended two mosques which have since been linked to extremist activity. Padilla formally converted to Islam in 1994, in the al-Islam mosque in Sunrise, south Florida. He married Cherie Maria Stultz, his girlfriend since 1992, but in 1998 he left his wife and moved to Egypt and changed his name to Abdullah al Muhajir, In 1999 or 2000 he went to Pakistan, and also visited Saudi Arabia and Afghanistan. In Pakistan he married the widow of a jihadist. In Afghanistan in 2001 he met Al Qaeda operative Abu Zubadayah, who sent him to Lahore, Pakistan for "training". There the pair developed the "plot" to create a dirty bomb, or "radiological dispersion device", using radioactive materials which would be stolen from within the US. The intended target of this plot was Washington, the capital.
Zubadayah was caught in March 2002, and spoke to FBI investigators of his associate from America, with whom plots of a dirty bomb had been developed.
Arrested at O'Hare International Airport on May 8, 2002, he was held as a material witness on a warrant issued in New York State, relating to the 9/11 attacks. He was ordered by President Bush to be detained as an "enemy combatant" on June 9, 2002. Currently, he resides at Hanahan in South Carolina. Sources: Wikipedia.org, Time, Crime Library.org.
