Iraq: Insurgents Guilty of War Crimes

A report from Human Rights Watch today states that "The various rationales offered by insurgent groups in Iraq for their attacks on civilians are not justified in international law." The 140 page report claims to be the most comprehensive study to date of the abuses carried out by the insurgents. The report, entitled "A Face and a Name: Civilian Victims of Insurgent Groups in Iraq" can be read HERE. On the same page, there is a 2mb pdf download also available, also available in Arabic should a certain Mr A. M. Al-Zarqawi feel like some bedtime reading matter.

The report does not diminish the scale of deaths through the conventional warfare that have already been carried out, nor the prison abuses of Abu Ghreib. But the actions taken by the insurgents against civilians have been truly horrific, with hostages beheaded, shootings, bombings, all carried out upon innocent citizens. From part of the document, on "Methodology":

The arguments of insurgent groups include:
  • in a war to drive foreign occupiers out of Iraq, the ends justify the means;
  • in a war against the military superpower of the world, an insurgency with small arms and explosives is obliged to go after non-military, or so-called "soft" targets;
  • insurgent groups are bound only by Islamic law, and not international humanitarian law;
  • Islamic law allows the killing of civilians in a war of self-defense;
  • the illegality of the U.S.-led attack on Iraq, as well as violations of the laws of war by the Multi-National Force, remove any obligation on insurgent groups to abide by the laws of war.
  • The report states:
    none of the arguments justify attacks which are in clear violation of international law. Regardless of the violations committed by US and Iraqi [ government] forces, almost daily attacks on civilians have had a devastating impact on the people of Iraq.

    "Insurgent groups have also tortured and summarily executed civilians and captured combatants in their custody, sometimes by beheading. And they have carried out attacks against legitimate military targets, such as army convoys, in such a manner that the foreseeable loss of civilian life was greatly disproportionate to the military gain."
