US: Muslim Loses his Claim for $1m Damages
Afghan-American Easa Begzad is not a happy bunny. A federal jury has thrown out his court case, in which he tried to sue the city of Hayward for violating his civil rights, according to the Californian Daily Review. He had claimed that two officers who arrested him in 2002 had made derogatory remarks about Islam. After two weeks of the trial, the jury at a US District Court in San Francisco ruled in favour of the two officers. His demand for I million dollars' compensation was rejected.
This sorry tale began in 2002 when a call was made from Begzad's business, a candy store which manufactured Afghan sweets. A property manager for the company that owned the building called 911 and said that Mr Begzad was threatening to kill himself and his family. Police Sgt Keith Bryan and Officer Kenneth Hedrick arrived in response to the call. Begzad's lawyer had claimed that when the officers saw religious tapestries and posters on the wall, they said "What's that garbage?"
The police officers denied making the remarks and took Begzad to a psychiatric unit at San Leandro, where he spent the night. Begzad claims the experience destroyed the family business and ruined his life.
He claimed police falsely imprisoned him, denied him due process when they took him to the mental hospital, intentionally inflicted emotional distress and discriminated against him on the basis of his religion.The city argued that for 13 months previous to the alleged incident his rents had been late and he also had lease violations. He had been treated for depression after the incident, but this began two years after the arrest and psychiatric detainment. Randolph Hom, argued the city's case:
Hom said Alocozy (one of Begzad's witnesses) also might have lost credibility with the jury because of his prior felony conviction on charges of perjury and welfare fraud.
