UK Home Secretary Tackles Judiciary and EU on Extremists
Today Charles Clarke, the UK Home Secretary, made statements addressed to Members of the European Parliament in Strasbourg, asking them to reconsider the terms under which Britain is a signatory to the European Convention on Human Rights (ECHR). He claims that Britain is at risk of more Al Qaeda terrorist threats, and that the ECHR's rules should be "rebalanced". He has the full support of Prime Minister Tony Blair.
According to the Daily Telegraph, he will over the next two days be broaching similar issues with fellow ministers at a summit in Newcastle. Because Article 3 of the ECHR forbids "inhumane or degrading treatment", it has meant that the Human Rights Court at Strasbourg has stated that even extremist Islamists should not be deported to countries where they may suffer poor treatment.
There at least 10 individuals on Charles Clarkes's list whom he wishes to ban, but judges who interpret the ECHR ruling have already implied that they would not allow these deportations to go ahead. He also had a message for the British judiciary, according to today's Times. Government-to-government deals, or memoranda, ensuring no torture nor death penalties should happen to these deportees in a number of countries, are already being negotiated, though have not formally been agreed. These countries include include Algeria, Lebanon, and North African and Middle Eastern states. Only Jordan has so far formally agreed to the deal outlined.
Mr Clarke has already asked some of his foreign counterparts to agree new rules on how long telecommunications companies should be required to store details of telephone calls and e-mails. But he has admitted the need for flexibility for a deal to be struck before the end of Britain's EU presidency in December.
